General Terms and Conditions (GTC) – Kabel Tech

1. Scope
These General Terms and Conditions apply to all deliveries and services of Kabel Tech GmbH (hereinafter referred to as “Kabel Tech”) to its customers. They apply in particular to:

• Cable assembly & wiring

• Technical drawings & CAD services

• System maintenance & order management

• Website design & digital solutions

• International material procurement

We do not recognize deviating terms and conditions of the customer unless we have expressly agreed to them in writing.

2. Terms of Payment

• For initial orders: advance payment

• For subsequent orders: payment within 14 days net

• Discounts or deductions require a separate written agreement

• If the customer is in default of payment, Kabel Tech is entitled to charge default interest at the statutory rate.

3. Delivery / Delivery Conditions

• Deliveries are made by arrangement and according to standard delivery times.

• Delivery is made ex warehouse or production site, unless otherwise agreed.

• Risk and costs of shipment pass to the customer upon handover to the carrier.

• Delivery dates are non-binding unless expressly agreed as binding.

4. Liability / Warranty

• Statutory warranty law applies.

• Kabel Tech is liable only for intent and gross negligence.

• Liability for indirect or consequential damages is excluded to the extent permitted by law.

• Warranty claims must be asserted within the statutory limitation periods.

5. Place of Jurisdiction / Applicable Law

• The law of the Federal Republic of Germany applies.

• Place of jurisdiction for all disputes arising from the contractual relationship is Nuremberg, Germany.

6. Withdrawal / Cancellation

• Orders may only be canceled with the written consent of Kabel Tech.

• Services already rendered or products already manufactured must be remunerated in such cases.

• Standard conditions for withdrawal and cancellation are applied in accordance with statutory provisions.

7. Final Provisions

• Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

• Amendments or supplements to these GTC must be made in writing.
